Terms of Service

These are our working terms.

We're a small company in our first months. These plain-English terms describe how we work today. Our formal Termly-managed terms will replace this page when we complete that integration. For questions in the meantime, email cj@aeryssoftware.com.

The deal in plain English

You're paying us a monthly fee. We're deploying and operating software for your trades business. We try really hard to make it work, and we'll give you your money back if it doesn't.

Who can sign up

You must be at least 18 years old and authorized to enter into a contract on behalf of your business. Aerys Software is sold to operators of legitimate trades businesses (painting, landscaping, power washing, pool service, and similar). We reserve the right to decline service to anyone, including for reasons of legal compliance, capacity, or fit.

Subscriptions and billing

Refunds

If something we built doesn't work or you're unhappy in the first 30 days, email us and we'll refund the most recent monthly fee. Setup fees are refundable only if we haven't started deployment.

Acceptable use

Don't use Aerys for anything illegal. Specifically:

Your data

Your data is yours. We process it to deliver the services you signed up for. Details are in our Privacy Policy and DPA.

Our service

We make every reasonable effort to keep our services online and working. We're a small company — sometimes things break. We'll fix them as fast as we can. We do not guarantee 100% uptime; we aim for 99% in any given month.

If we have to do scheduled maintenance, we'll give you advance notice.

Liability

Our maximum liability to you for anything related to our service is the amount you paid us in the prior 12 months. We're not liable for indirect damages, lost profits, or business interruption beyond that.

Changes to these terms

When we update these terms, we'll change the "Last updated" date at the top. For material changes, we'll email customers directly. Continued use of our services after a change constitutes acceptance.

Disputes

If we have a disagreement, let's try to work it out by email first. If we can't, disputes are governed by Florida law and resolved in the courts of Orange County, Florida.
